The U.N. Threat to the Second Amendment Becomes Real

At the direction of President Barack Obama, the United States has now become a signatory nation to the United Nation’s Arms Trade Treaty.

If this treaty were to be ratified by the United States Senate it would impose an "invasive registration scheme" by requiring importing countries to give exporting countries information on "end users," according to an analysis of the treaty prepared by the National Rifle Association.

Our friends at Gun Owners of America also have a detailed analysis that you can read here, but the key points are that the U.N. Arms Trade Treaty would:

· ban large categories of firearms, including semi-automatics and handguns;
· require universal gun registration and licensure;
· require microstamping and, through that requirement, effectively ban most guns and ammunition.

However, as GOA noted, the real threat is that “Given Obama’s record of expansively interpreting statutes -- and even ignoring them -- we have to assume that the ATT would be implemented in the broadest possible manner. And, because under cases interpreting Article I and the Supremacy Clause, a treaty has the force of law, no further congressional action would be necessary for the ATT gun bans and registration to be put into effect.”

In other words, it is not only the details of the treaty that are a threat – it is the surrender of American sovereignty that the treaty requires that make it even more dangerous to our Second Amendment rights.

Fortunately, a number of Senators, led by Senator Jim Inhofe of Oklahoma, have already said “no way” to Obama’s attempt to give away American sovereignty and undermine the Constitution through this treaty.

On March 23, 2013, Inhofe was able to force the last vote on the Senate Budget resolution to be on his amendment to block the U.S. from joining the U.N. Arms Trade Treaty. Fifty-three Senators from both parties went on the record and voted against the treaty, meaning the President does not have the necessary two-thirds majority required by the Constitution for ratification of a treaty. 

Senator Inhofe has now sent a letter to Obama (which you can read here) reminding Secretary of State John Kerry that the Administration lacks the two-thirds support in the Senate necessary to ratify the treaty.

Given Obama’s record of ignoring the Constitution, let alone the laws Congress passes, we urge you to call or e-mail your Senators (the Capitol switchboard is 1-866-220-0044) to demand that they be vigilant against any Obama action to implement the United Nation’s Arms Trade Treaty through executive orders or other extra-constitutional means.
