The Left’s Bizarre New Cause: Gender “Fluidity”

Conservatives and other normal Americans can add one more far-Left social “justice” landmine to the growing list of political correctness hazards Obama is daily imposing upon them: the right to gender fluidity. 

The Obama Department of Justice has announced that North Carolina’s new law that protects women and Gender fluidchildren from potential sexual predators in public rest rooms violates the civil rights of “gender fluid” individuals. 

In a letter addressed to North Carolina’s Republican Governor Pat McCrory the Obama’s DOJ says it has determined that, “as a result of compliance with and implementation of North Carolina House Bill 2…both you and the state of North Carolina…are in violation of Title VII of the Civil Rights Act of 1964, as amended…”. 

Far from being discriminatory, as our friend Dr. Susan Barry points out in an article for Brietbart, the North Carolina law “affirms the long-standing public preference that men should use men’s bathrooms, and women should use women’s bathrooms.” 

Liberal social “justice” warriors, says Barry, claim the law discriminates against transgendered individuals or anyone who – at any given time of the day – believes he or she is a member of the opposite sex and wishes to use the bathroom of that sex. 

And Obama’s Justice Department agrees, announcing in their letter to Governor McCrory:

Specifically, the State is engaging in a pattern or practice of discrimination against transgender state employees and both you, in your official capacity, and the State are engaging in a pattern or practice of resistance to the full enjoyment of Title VII rights by transgender employees of public agencies… 

Access to sex-segregated restrooms and other workplace facilities consistent with gender identity is a term, condition, or privilege of employment. Denying such access to transgender individuals, whose gender identity is different from their gender assigned at birth, while affording it to similarly situated non-transgender employees, violates Title VII… 

Based upon the above, we have concluded that, in violation of Title VII, the State is engaged in a pattern or practice of discrimination against its employees and both you and the State are engaged in a pattern or practice of resistance to the full enjoyment of Title VII rights by employees of public agencies. When the Attorney General of the United States has a reasonable basis to believe that a state or person has engaged in a pattern or practice of discrimination in violation of Title VII, she may apply to the appropriate court for an order that will ensure compliance… 

Now the key to what a vast expansion of Title VII rights protection this new position of Obama’s is this: Heretofore, what mattered was, shall we say one’s equipment.  

As Dr. Barry reported for Breitbart, Governor McCrory signed the privacy and public safety bill into law to replace an ordinance in Charlotte that allowed any man who simply declared himself to be a woman to use women’s restrooms. That ordinance was pushed forward by registered sex offender Chad Sevearance. 

As Dr. Barry noted, the new state law is a compromise measure because it requires that people use the bathroom that matches the sex on their birth certificate. That means transgender people can change their legal sex — and then legally use the bathrooms they prefer — after they begin medical procedures to help change their sexual appearance. 

Thus, if one had completed sex-reassignment surgery, and changed one’s birth certificate to the newly assigned sex, one was considered to be a person of the newly assigned sex – regardless of one’s genetic sex. 

Now, according to the Obama Department of Justice, and its concept of “gender fluidity,” the only thing that matters is what one thinks about one’s sexual identity at any given moment. 

Cogito ergo sum, said René Descartes – I think, therefore I am.  

But one of the fundamental tests of mental health and rationality is self-awareness: If I think I am a monkey, or a breadfruit, when I am a human being – or if I think I am a woman, when I am genetically a man – I am denying reality and am in an abnormal state of mind. 

Courts and society have determined that people have the civil right to control their own bodies and appearance, thus changing one’s sexual appearance is allowed, if not universally embraced or recognized as a choice a mentally healthy person would make. 

But a civil right to – minute by minute – change one’s toilet habits and position? 

In a more rational time this would be recognized as the federal government institutionalizing a civil right to be mentally ill and to act out that illness without regard to the rights of others. But with Obama in charge of the federal government, rationality long ago left federal policy-making to be replaced by the drive to fundamentally change American society, regardless of how irrational and deviant the outcome.

not so common sense

It is with some surprise I note the traction the North Carolina HB2 law continues to garner. The list of businesses and performers boycotting North Carolina seems to grow almost hourly, and now the presidential candidates are opining as well. Before the country completely loses its collective mind over over this issue, it might be a good idea to take a serious look at the law, and the concern its actually addressing.

Most Americans are pretty much live and let live. We really don't care how the neighbor lives, because we don't want him or her judging us. Should he choose to put on a dress and feel like a woman, we may chuckle, we may not, but we really don't care too much, because we're busy leading our own lives.

However, just as my right to swing my fist stops at the end of your nose, your right to live as you wish is conditioned by the simple precept of doing no harm to others. Most LGBT people I've known completely get this, and have no more desire to do harm to others than anyone else.

Let me be clear, the HB2 law is not really about the LGBT community at all. Its about predators, people who intentionally seek to do, not just harm, but often great harm to others. Those who take any opportunity to catch victims in a defenseless position, such as in a public bathroom, locker room or shower. Why in the world would we offer legal access based on a desire, rather than reality?

Gender fluid

This whole issue can be settled simply: Those with XX chromosomes use the Ladies' room; those with XY chromosomes use the Men's room. Those few confused individuals who are not sure can be tested to see which gender they are. Until you can find a way to change your chromosomes, XX persons stay out of the men's room; XY stay out of the ladies' room!
