Neo Cons Hammer Rand Paul For Upholding His Oath Of Office

Senator Rand Paul – the Senate’s leading advocate of privacy and your Fourth Amendment rights – has announced that he is filing a class-action lawsuit against the National Security Agency.

According to our friend Bob Unruh of WND, the action is to be brought by Paul as a citizen, not as a senator, and apparently will charge that the surveillance program the NSA uses to gather metadata on U.S. citizens violates the Fourth Amendment. 

Although he had been talking about the idea for some time, Senator Paul’s plan to sue apparently gathered steam after last month’s favorable ruling in a class-action legal challenge to NSA spy operations by attorney Larry Klayman, founder of Judicial Watch and Freedom Watch. In that case the federal judge said the spy program is likely unconstitutional. The Obama administration has said it will file an appeal in Klayman’s case.

Predictably, as soon as word of Senator Paul’s planned lawsuit hit the press one of Capitol Hill’s leading neo cons, Rep. Peter King (NY-2), lashed out against him for his opposition to the National Security Agency's controversial surveillance programs.

In a Fox News interview on Sunday, January 5, 2013, King said, “Rand Paul does not know what he’s talking about. And, Rand Paul is really spreading fear among the American people," King said. “To me, he’s either totally uninformed or he’s part of that hate America crowd that I thought left us in the 1960s."

"In any event, he doesn’t deserve to be in the United States Senate for spreading that type of misperception and absolute lies to be honest with you," King continued.

Doesn’t deserve to be in the Senate for defending his constitutional rights under the Fourth Amendment?

Apparently Congressman King, a long-time member of the House Permanent Select Committee on Intelligence – that would be one of the Committees that failed in its oversight duties regarding the NSA – hasn’t read his oath of office lately.

The Constitution in Article VI, clause 3 provides that, ““The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution; but no religious Test shall ever be required as a Qualification to any Office or public Trust under the United States.”

5 U.S.C. §3331. "Oath of office" is the current law providing the language of the congressional oath of office. It says, “I, AB, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God.”

Note to Congressman King: This oath does not bind the person taking it to the government of the United States or the President, and it certainly doesn’t bind the one taking it to obedience to a faceless and unaccountable bureaucracy like the National Security Agency.

The argument that the government is destroying liberty to make citizens safe is as old as tyranny itself and it is one that requires the courage and vigilance of every citizen to oppose. 

The congressional oath of office binds the oath-taker to “support and defend the Constitution of the United States against all enemies, foreign and domestic.” Right now it is hard to imagine a domestic enemy of the Constitution that is more potent than the NSA.

In filing a lawsuit as a private citizen against the NSA Senator Rand Paul is exercising his constitutional rights, and fulfilling his oath of office to “support and defend the Constitution of the United States against all enemies.” Far from spreading fear or being part of some “hate America crowd” as Congressman King and his neo con allies claim, Rand Paul is standing-up for the Constitution and deserves the thanks of all liberty loving Americans for doing so.

My only question is why are the other so called defenders of the Constitution not brave enough to make the same stand, or at least publicly voicing their support for Rand? Peter King sure shows his true colors this time, and they are not red, white, and blue.
