Petition to Impeach Mark Herring

To: Speaker of the Virginia House of Delegates William J. Howell

Virginia Attorney General Mark Herring is abusing the powers of his new office to advance the radical liberal agenda, and in doing so, has become one of Virginia's premier lawbreakers. Law-abiding citizens across the nation demand that Herring's breaking of the state constitution's laws be stopped immediately. He must be removed from office to demonstrate that We the People will not stand for it when any state officeholder abuses his powers and overrides the laws enacted by the People's representatives.

We the undersigned call on Virginia's House of Delegates to begin impeachment proceedings against Attorney General Mark Herring for refusing to uphold existing laws and the Virginia Constitution, as stated in the Draft Resolution. Herring's impeachable offenses are outlined as follows:
  1. Virginia Attorney General Mark Herring has refused to preserve, protect and defend a provision of the Bill of Rights of the Virginia Constitution;
  2. The Virginia Constitution is paramount law that establishes, constitutes and governs the government of the Commonwealth of Virginia, including creating the elected, constitutional office of Attorney General;
  3. General Herring has chosen to disregard that paramount law that governs his office, and is violating his oath of office to preserve, protect and defend the Constitution, which constitute a neglect of duty;
  4. Section 2 of Article I, “People the source of power,” states “That all power is vested in, and consequently derived from, the people, that magistrates are their trustees and servants, and at all times amenable to them;”
  5. By refusing to enforce one of the rights in the Virginia Bill of Rights, General Herring has renounced his oath of office, which will set dangerous precedent that he may refuse to enforce the Constitution, including the rights articulated in the Bill of Rights;
  6. The nature of General Herring’s neglect of duty is not only unprecedented, but is a danger to all Virginians because without adherence to the paramount law that governs the government of Virginia, all rights of Virginians are at the mercy of government unconstrained by the rule of law;
  7. Article IV, Section 17 of the Constitution states that the Attorney General “offending against the Commonwealth by malfeasance in office, corruption, neglect of duty, or other high crime or misdemeanor may be impeached by the House of Delegates and prosecuted before the Senate, which shall have the sole power to try impeachments;”
We demand that the House of Delegates take action now and fulfill its constitutional duty by commencing the impeachment of Virginia Attorney General Mark Herring for his unconstitutional activities.

Mark Herring Impeachment

When I first read about his choice to selectively not follow the rule of law regarding gay marriage ban in Virginia, I was 'all in' for his impeachment. Later that day I read his retort to the accusations against him that the previous AG, Cuccinelli, and one before him, both Republicans, did virtually the same thing. At that point I backed off until I get smarter about 'the facts.'

I no longer believe almost anything I read, regardless of authorship, as truth, honesty, integrity, and veracity have become the fatal victims of our discourteous, vindictive, dishonest and immoral political system, on both sides. I no longer take any politician at merely his or her word. We all have to do a much better job at Reagan's 'VERIFY.'

If what Herring said about the two former Republican AG's is accurate, then in fairness, I cannot and will not condemn Herring for the same tactic. Fairness is another 'victims' of our politics. I am as Conservative as any Tea Partier although I refuse to be pigeon-holed as one. That makes 'those' people much too easy to accuse and condemn merely by association. The Dems love doing that. Democrat, Republican, Tea Party are organizations. Conservative is a FRAME OF MIND, A WAY OF LIFE! Even though they share commonalities, they can be mutually exclusive.

As a conservative, I am resigned to the fact that negotiations AND compromises MUST be made but not when it comes to basic rights and core beliefs. In that regard, I am much like a Dem. You never see them cave in on THEIR core rights and beliefs. That is where I depart from the RINO's and maybe Huckabee. They are all to quick to 'rationalize' away the parties rights and beliefs (IMO.)

How do you know Herring wasn't lying?

You stated "I no longer believe almost anything I read, regardless of authorship", and yet, followed that with a string of Herring's statements as if they were 100% fact. Why do you believe what Herring said about previous AG's, but doubt the solid proof of his disregard for the state constitution, as outlined in the draft articles of impeachment?

What he said was....

That he will hold off on political action until he has more and better information. Good for him!! Or maybe "her". It's a pity that more folks do not show similar restraint.
