Texans Stand Tall Against BLM

Texas Governor Rick Perry and the state’s Attorney General (and GOP gubernatorial candidate) Greg Abbott have a message for federal bureaucrats contemplating seizing 90,000 acres of private property along the Red River: Don’t mess with Texas.

In response to reports, such as a CHQ article connecting the dots, about the BLM “preliminary review” Abbott sent a letter to the BLM on Tuesday urging the feds to “stay out of Texas.” Governor Perry said he stands with his attorney general when it comes to Texans’ property rights.

FOX News and other outlets have reported that “At issue are thousands of acres of land on the Texas side of the Red River, along the border between Texas and Oklahoma. Officials recently have raised concern that the BLM might be looking at claiming 90,000 acres of land as part of the public domain.”

The reports refer to a 1986 federal court case in which Texas landowner Tommy Henderson lost 140 acres to the BLM. Now he claims the agency is using that court decision as precedent to claim more land.

“It’s not a dare, it’s a promise that we’re going to stand up for private property rights in the state of Texas,” Perry said.

But Greg Abbott’s letter to the BLM really got to the heart of the matter:

“I am deeply concerned about the notion that the Bureau of Land Management believes the federal government has the authority to swoop in and take land that has been owned and cultivated by Texas landowners for generations. The BLM’s newly asserted claims to land along the Red River threaten to upset long-settled private property rights and undermine fundamental principles—including the rule of law—that form the foundation of our democracy. Yet, the BLM has failed to disclose either its full intentions or the legal justification for its proposed actions. Decisions of this magnitude must not be made inside a bureaucratic black box.”

The proposed BLM land grab in Texas is of a piece with the other lawless actions of the Obama Administration.

As CHQ Chairman Richard Viguerie noted in his new book TAKEOVER, and in the e-pamphlet “The Law that Governs Government” he authored with attorney Mark Fitzgibbons, government has become the Nation’s number one lawbreaker – especially during the Obama presidency.

The only sure defense against a lawless government is We the People.

As Viguerie noted in both publications, James Madison, father of the Constitution, foresaw the potential for lawless government in Federalist 44. Madison said in the last resort a remedy must be obtained from the people who can, by the election of more faithful representatives, annul the acts of the “usurpers,” his word for lawbreaking public officials.

Madison had the remedy right in the case of lawbreaking elected officials, but what of lawbreaking by today’s vast unelected federal bureaucracy?

The answer it would seem, short of daily repeats of the potentially deadly standoff at the Bundy Ranch, is to elected constitutionalists like Rick Perry and Greg Abbott who will have the good sense and commitment to the rule of law to rein-in the unelected “usurpers” in the federal bureaucracy.
