On Monday, December 7, 2020 at 3:45 PM local time more than two dozen Members and
Members-Elect of the Arizona Legislature made a joint statement in the courtyard of the State Capitol to discuss the urgent need to decertify the results of the 2020 election. Select participating members offered the following statements:
“The election should not have been certified with the number of irregularities and allegations of fraud. Especially troubling to me are the allegations surrounding the vendor Dominion. It is imperative that a forensic audit occur immediately of the equipment and software. Upon any showing of fraud the legislature should immediately convene to decertify the vote.” –House Majority Leader Warren Petersen
“In the past week seemingly conclusive evidence has come to light through successful litigation that the outcome of the 2020 election is far from certain, and at the very least, further investigation is necessary to ensure the integrity of Arizona’s election results. It is imperative that Secretary of State Hobbs rescind her certification of the election until these matters have made their way through the court and voter confidence is restored.” –Representative Walter Blackman
“Ensuring the integrity of Arizona’s 2020 election isn’t just a matter of sound public policy, it is a civil rights imperative. There are few elements of our society more foundational than the right to free and fair elections and when that right is called into question it is our responsibility as leaders to ensure that confidence in the electoral process is restored. To this end, Arizona must decertify the 2020 election so that the numerous election irregularities may be properly adjudicated and the people of our great state may once again have faith in their right to vote.” –Representative-Elect Jake Hoffman
The statements from these stalwart conservatives demanding the legislature exercise its constitutional power to ensure free and fair elections is in stark contrast to the positions taken by Arizona’s establishment Republican “leaders.”
Republican Speaker of the Arizona House of Representatives Rusty Bowers called the damning evidence of election fraud already uncovered "unsupported" and said Friday, "As a conservative Republican, I don’t like the results of the presidential election," Bowers said in a prepared statement. "I voted for President Trump and worked hard to reelect him. But I cannot and will not entertain a suggestion that we violate current law to change the outcome of a certified election."
However, Rep. Mark Finchem, of Oro Valley, said on Twitter Friday morning. "I believe that (Gov. Doug Ducey) signed a fraudulent document. And he knew it! I’m requesting we recall Arizona’s certification." Later in the day, he cited a portion of the U.S. Constitution that grants the Legislature the power to choose a state's slate of electors.
"Gov. Ducey says he ‘did his job’. Now it’s time for us to do ours," Finchem wrote.
"It is imperative that Arizona's legislators use our Article 2 power and choose the electors after everything we have seen here," Rep. Kelly Townsend wrote on Twitter in the afternoon. "I do not want to go down in history as doing nothing about it."
We agree with Arizona conservative rock stars Representative-elect Jake Hoffman and Representatives Kelly Townsend, Mark Finchem and Walter Blackman – the U.S. Constitution places the responsibility for the appointment of Electors in the hands of the state legislature and they can and should decertify the election until litigation of the blatant vote fraud in Arizona is concluded and Electors untainted by fraud can be appointed.
