The conservative leaders who participate in the Conservative Action Project have just released a Memo for the Movement entitled "Conservatives Applaud Justice Alito and The

Supreme Court’s Work on Roe v Wade." The memo makes the point that the unhinged overreaction from the left has willfully misrepresented the impact of a final ruling which strikes down Roe. There will be no “nationwide abortion ban.” Rather, the issue of abortion policy will simply return to the states, where voters, rather than unelected judges, will decide the issue for themselves.

Despite the unprecedented and egregious nature of the recent leak from the Supreme Court, the conservative movement is thrilled with the superb legal reasoning and analysis presented by Justice Samuel Alito in his draft opinion striking down Roe v Wade.
While we acknowledge the draft nature of the opinion, we are tremendously gratified to see the Court acknowledge what the conservative movement and legal practitioners across the spectrum have known for decades: since its inception, Roe was wrongly decided.
As Justice Alito stated in the draft opinion, “Roe was “egregiously wrong from the start,” its reasoning was “exceptionally weak,” and it has had “damaging consequences.” Moreover, Alito wrote that, “It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives…. That is what the Constitution and the rule of law demand.”
The unhinged overreaction from the left has willfully misrepresented the impact of a final ruling which strikes down Roe. There will be no “nationwide abortion ban.” Rather, the issue of abortion policy will simply return to the states, where voters, rather than unelected judges, will decide the issue for themselves.
Indeed, as Alito’s draft opinion stresses that this is an issue that should not be determined by judicial fiat, but rather by the democratic process: “The permissibility of abortion, and the limitations upon it are to be resolved like most important questions in our democracy: by citizens trying to persuade one another and then voting,” he wrote.
For the first time in 50 years, the pro-abortion movement will have to justify their cause in the democratic arena, which entails defending the gruesome and horrific practices of abortion and the blatant exploitation of women on which the abortion industry relies.
The left has engaged in a vicious assault on the norms of the Court and the country to prevent this democratic process from happening. Whoever leaked the draft of an opinion in a pending case is engaged in an overt attempt to bully the Court out of its deliberative proceedings and shake the foundations of an impartial application of the rule of law. We condemn it in the strongest terms.
We are profoundly grateful for the deeply researched and clearly reasoned scholarship of Justice Alito and those who stand with him. It would be our greatest privilege to see Roe struck down in our lifetimes – and to celebrate the lives of the millions of unique and precious souls who will be saved as a result.
As a movement, we have stood arm-in-arm to defend the cause of life for decades. We will continue to support pregnant mothers throughout every stage of pregnancy and motherhood and defend the cause of human dignity through resources, state, and federal policy advocacy.
We urge the Court to remain steady in its work and committed to its course. And we look forward to a final opinion that rights the tragic wrongs of Roe.
