GOP Making Biden Impeachment Way Too Complicated

The House Republican inquiry into the impeachment of President Joe Biden has slipped off the front page and appears to have all but disappeared from the public consciousness.


And it is fair to say that is by design, as many of the Republican Party’s alleged “leaders” lack the courage and communications skills to push the inquiry forward, while more capable others, such as Representatives Jim Jordan, James Comer and Jason Smith have gotten bogged down in the minutia of the Biden family’s many corruption schemes.

 

Don’t get us wrong, there’s a lot of utility in investigating the Biden family’s astonishingly blatant corruption, but that is apparently in the past, and Biden’s most obvious impeachable crime, intentionally collapsing the border, is ongoing today.


The president’s oath of office, as set forth in the Constitution says, “I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States.”

 

In the penultimate clause of Article II, Section 3, of the Constitution the President is required to “take Care that the Laws be faithfully executed.”

 

This is not a discretionary clause, the word “shall” means that faithful execution of the laws is required of the President, and in the matter of collapsing the border Joe Biden is clearly violating not only his oath, but the plain language of the Constitution.

 

In an essay for the National Constitution Center William P. Marshall and Saikrishna B. Prakash maintain that President George Washington observed, “it is my duty to see the Laws executed: to permit them to be trampled upon with impunity would be repugnant to” that duty.

 

At a minimum, wrote Marshall and Prakash the Clause means that the President may neither breach federal law nor order his or her subordinates to do so, for defiance cannot be considered faithful execution. The Constitution also incorporates the English bars on dispensing or suspending the law, with some supposing that the Clause itself prohibits both. Hence the Constitution itself never grants the President authority to either authorize private violations of the law (issue individualized dispensations) or nullify laws (suspend their operation).


Clearly Biden has, at a minimum, ordered his subordinates to suspend or breach the immigration laws passed by Congress.


Merrill Matthews, a resident scholar with the Institute for Policy Innovation in Dallas, Texas, writing for The Hill, estimates that 10 million illegal aliens have enter the United States since Joe Biden became President.


Besides the 8.5 million encountered by the Border Patrol, Matthews cited estimates that there are those who entered the U.S. illegally with the express intent of avoiding detection. Estimates put that number at 1.7 million “gotaways” over the past three years, which gives us the 10 million estimate.

 

This goes far beyond any realistic claim of “prosecutorial discretion” and enters the realm of intentional disregard for the law.


Even worse, the vast amount of evidence pointing to the hostile intentions of many of these illegal entrants provides a basis for charges that failing to enforce the border amounts to treason or in the most charitable light, failure to faithfully execute the duties of the Commander-in-Chief to repel an invasion.


Thanks to Joe Biden’s open border policy, thousands of Communist Chinese citizens, mostly young, fit men of military age, have infiltrated the United States. A Communist Chinese People’s Liberation Army (PLA) infantry regiment has around 2,800 personnel and a battalion has 700. These numbers vary somewhat depending on the unit’s assignment and equipment, but according to the Biden administration’s own numbers the equivalent of at least six battalions of Communist Chinese have entered the United States since Joe Biden took office.

 

According to Red Chinese sources PLA Special Operations units vary in size from 100 to 1000 personnel, meaning we could have as many as 42 Communist Chinese Special Operations Units already here waiting for orders.


If these enemies showed up at the border armed and in uniform would Joe Biden turn them away?


Presumably the Constitution requires him to do so – so why doesn’t it require him to repel the surreptitious invasion going on right now?


The answer is that the Constitution does require him to do so, not only because it requires the President to faithfully execute the laws, and because it also requires the President to defend the sovereignty of the United States, and failing to do so is the ultimate impeachable offense.
