Justice Stephen Breyer, 83, and the oldest member of the U.S. Supreme Court (SCOTUS), will retire at the end of the court’s current term that runs through the end of June, NBC News and CNN have reported.
This is not the first time the Leftwing news media have reported Breyer is about to retire, a similar flurry of reports about Breyer’s imminent retirement came out last year near the end of the Supreme Court’s term, but this time Breyer has not stepped up to immediately knock the story down.
Biden during the 2020 presidential election campaign pledged to nominate a black woman to fill any Supreme Court vacancy, which would be a historic first. Biden’s fellow Democrats hold a razor-thin majority in the U.S. Senate, which under the U.S. Constitution gets to confirm Supreme Court nominees.
As Allen Zhong reported for The Epoch Times, after Biden defeated Trump in the 2020 election, some liberal activists urged Breyer to step aside while Democrats control the Senate, concerned that if he does not do so, Republicans could block confirmation of his successor in the chamber or a future Republican president could be able to name his replacement and tilt the court even further to the right.
A Biden appointee would not change the court’s ideological balance but would enable him to refresh its liberal wing with a much younger jurist in the lifetime post.
Assuming the latest stories about a Breyer retirement are true, we expect Biden to nominate the most Far Left “woke” progressive he can find who can pass the red face test with Senate Democrats. Which means the 2022 Senate campaigns will be all about who gets nominated and how the Senate candidates vote or would vote on the nomination.
And as a further example of how nuts Democrats are going to go about this nomination, there’s even talk of Biden nominating Vice President Kamala Harris, one of the worst lawyers in America to fill the vacancy, thereby setting off a massive musical chairs scramble among Democrats for the Vice Presidency and a leg up to be Biden’s successor.
Republicans may see this as a great spectator sport, but they can throw away all those position papers and talking points because, whether they like it or not, come Election Day the only question a lot of voters will ask is how they voted or would have voted on the most Far Left judge ever nominated to the Nation’s highest court.

The authors of the Constitution didn't see this coming. Impeachment is the way to get rid of a totally incompetent president who is harming the country but, if this were chess, Republicans would be checked by Nancy Pelosi on one hand and Kamala Harris on the other. Perhaps the press could help but they are further checking any move to restore competency in the White House.
"...a future Republican president could be able to name his replacement and tilt the court even further to the right."
You mean further to the center. I say that because justices always tend to move to the left but you never see them move to the right. Also, leftist justices can be counted on to rule leftist accept in the narrow cases where no amount of leftist rationalization can get around the plain words of the Constitution, while conservative (have we finally abandonded the correct but antiquated term "constructionist"?) are often tempted by the lure of leftist rationalization so they can make "historic" (i.e. anti Constitutional) rulings and become "relevant".
This is not meant to be sarcastic nor is it a rhetorical question. But since when has the Constitution actually meant anything to a liberal? Unless of course they plan on using it for toilet paper.
Replacing a leftist with a leftist...So what?
